News: Developers, Designers To Be Made Responsible For Workers’ Safety

The Ministry of Human Resources (MOHR) will put up specific rules and regulations that will extend the responsibility for construction workers’ safety to developers and designers. 

“There must be more stringent compliance, the Department of Occupational Safety and Health (DOSH) has already sent it (regulations) to the AG’s Chambers,” said MOHR Minister M Kula Segaran as reported in Bernama. 

Under the current rules on employee safety and health, it is the contractor that shoulders the full burden. As such, Kula Segaran want it enlarged, making it the responsibility of the contractor, designer and developers, “because they are part of the team”.

“We want them to be jointly responsible, so they can keep up to certain standards. They know they have to fulfil these standards… so it should be coming anytime for me to gazette it.”

He made the statement following a visit to the site of Taman Desa condominium which suffered a partial collapse last Friday (14 February), trapping two Bangladeshi workers.

The 37-storey project’s sixth floor car park flooring reportedly caved in during heavy rain at 3:30pm.

The two workers were then rescued at 5:15pm and 9:40pm respectively and brought to the Kuala Lumpur Hospital.

Meanwhile, the forensics team is in the middle of identifying the main cause of the collapse.

“I have been informed that the forensics will look at it, they will take all the cement and other things, our drones have also gone to some difficult places (to reach in person), a report is being prepared and will be made known soon,” said Kula Segaran.

As to whether the workers have valid working permits, the minister explained that they are still investigating it.

The minister assured that if any offence is discovered, they would take the necessary action against the developer. However, he advised people not to speculate on the matter.
